Attack charges can be divided into three levels. Each person has their own penalty based on the level of injury. The law does not care if the act was intentional or just negligent - if the case does not fall under the category of "self-defense", the degree of injury remains the same.
Assault is first, second, or third degree depending on whether the damage is described as "serious injury" or "bodily injury." The difference between the two means significantly different sentence lengths and other criminal records if convicted. First degree assault requires serious bodily injury and is defined as an injury that causes serious death, disfigurement, long-term loss, or impairment of any bodily function, whether to a limb or another. These include broken bones, second and third degree burns, and fractures.
Physical injury is also included in second and third degree assault charges, and usually refers to physical pain, illness, or impairment of physical or mental functioning. In this sense, "You pinched me and it hurt me." It is very small and does not even require treatment.

First-degree assault is considered a violent crime, a third-degree felony, and is punishable by at least six years in prison. This allows a lawyer to charge it as second-degree assault rather than third-degree assault and reduce the sentence, usually a minimum of two years.
If the case is filed under self-defense, this is a defense of your innocence and the need to attack or injure another person to protect yourself from harm.
What differentiates second degree assault is that first, the level of physical injury - serious/potentially fatal harm to another person is classified as first degree assault, and second degree assault involving fatal injury, even if it still involves bodily harm. The definition of physical injury/injury includes physical pain, illness, cut, scrape, burn, injury or disequilibrium, impairment of bodily function, limb or mental function. Second-degree assault is still charged with knowingly or recklessly causing physical harm to another person, as well as harming a protected employee in the performance of his duties.
